Terms and Conditions

1. Scope

These General Terms and Conditions apply to all offers, orders, and services in the field of photography, film, and accompanying creative services (e.g., interviews, text portraits, concept development) provided by Marie Ortsiefer. Any deviating agreements must be confirmed in writing.

2. Offer and order placement

After the free introductory meeting, the client will receive an individual offer. The order is considered binding upon written confirmation of the offer (e.g., by email).

3. Fees and payment terms

Prices are quoted in euros plus statutory value-added tax and any travel expenses incurred. Payment shall be made in advance by bank transfer. The invoice is due upon receipt and before the start of implementation. Detailed preparation and implementation of the project will only begin after receipt of payment.

4. Services and obligations to cooperate

The specific content, formats, and accompanying forms (e.g., portrait, reportage, film) are based on the confirmed offer. The client undertakes to provide all information, agreements and, if applicable, access to locations/participants necessary for implementation in a timely manner.

5. Rights of use

Marie Ortsiefer remains the author of all images, films and texts created. The client receives the simple right of use for the agreed purposes (e.g. website, social media, print). Any further use or transfer to third parties is not permitted. With consent, selected works may be used for Marie Ortsiefer's own portfolio and public relations work.

6. Withdrawal and cancellation

In the event of withdrawal after order confirmation, the following cancellation fees apply:

  • up to 7 days before the agreed date: 50% of the fee

  • From 3 days before the date: 80% of the fee

  • For cancellations less than 48 hours in advance: 100% of the fee

An alternative date can be agreed upon by mutual agreement. In the event of cancellations due to illness or weather conditions, the postponement will of course be free of charge.

7. Liability

No liability is accepted for technical failures or unforeseeable events beyond Marie Ortsiefer's control (e.g., illness, accident, natural disasters, official orders, or force majeure). In such cases, the order will be postponed free of charge, if possible.

Marie Ortsiefer shall only be liable for slight negligence in the event of a breach of essential contractual obligations (cardinal obligations). In such cases, liability shall be limited to the foreseeable damage typical for this type of contract. Liability for indirect damage, in particular for loss of profit or data loss due to technical defects (e.g. camera, storage, or transmission errors) is excluded, unless there is gross negligence or intentional conduct.

8. Final provisions

To the extent permitted by law, the place of jurisdiction is the place of residence of Marie Ortsiefer. The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
